Privacy Policy

This Privacy Policy explains how Quantum Capital handles personal information in connection with the Site and its business as a broker and advisor of debt instruments. It is designed to reflect the principles of Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

1. Our commitment to your privacy

Quantum Capital respects your privacy and is committed to protecting the personal information we hold. This Privacy Policy describes the personal information we collect, why we collect it, how we use, disclose, and safeguard it, and the choices and rights available to you. Because we help arrange debt financing, this often includes sensitive credit and financial information. This Policy applies to personal information we collect through the Site, through our services, and in the course of our business.

2. What is personal information

"Personal information" means information about an identifiable individual, such as your name, contact details, date of birth, government identifiers, financial and credit information, and employment information. It does not include the business contact information of an individual that we collect and use solely to communicate with that person in relation to their employment or profession, or information that has been anonymized or aggregated so that it can no longer identify you.

3. Accountability and our Privacy Officer

Quantum Capital is responsible for the personal information under its control. We have designated a Privacy Officer who is accountable for our compliance with this Privacy Policy and applicable privacy laws. You can reach our Privacy Officer using the contact details in Section 15.

4. The personal information we collect

Depending on how you interact with us, we may collect:

•     Identification and contact information — such as your name, mailing and email addresses, and telephone number;

•     Credit and financial information — where you request or apply for financing, information needed to assess and arrange it and to meet legal obligations, such as date of birth, government-issued identification, social insurance number (where permitted and required, for example for identity verification or tax reporting), income, employment, assets and liabilities, existing debts and obligations, banking details, and credit history and credit scores;

•     Application and transaction information — such as the financing you are seeking, the applications we submit on your behalf, and the terms offered or entered into;

•     Website and technical information — such as your IP address, browser type, device information, pages visited, and other analytics data collected automatically when you use the Site (see Section 8); and

•     Communications — records of your correspondence and other interactions with us.

5. How we collect personal information

We collect personal information directly from you — for example, when you contact us, complete a form, or apply for financing. With your consent or as permitted or required by law, we may also collect information from third parties such as credit reporting agencies (credit bureaus such as Equifax and TransUnion), lenders and financial institutions, employers and references you provide, and government or regulatory bodies, and automatically through the technologies described in Section 8.

6. Why we collect, use, and disclose personal information

We collect, use, and disclose personal information for purposes that a reasonable person would consider appropriate in the circumstances, including to:

•     respond to your inquiries and provide information about our services and available financing;

•     establish and verify your identity and assess your eligibility and creditworthiness;

•     obtain and review credit reports and scores from credit reporting agencies;

•     operate, maintain, secure, and improve the Site and our services;

•     send you administrative and, where you have consented, marketing communications; and

•     detect, prevent, and address fraud, security issues, and other unlawful activity.

7. Consent

We collect, use, and disclose personal information with your consent, except where the law permits or requires us to do so without consent. Your consent may be express or, depending on the sensitivity of the information and the circumstances, implied through your provision of information or your use of the Site and our services. In particular, when you ask us to arrange or advise on financing, you expressly authorize us to obtain credit reports and scores about you from credit reporting agencies and to collect, use, and disclose your personal information as described in this Policy for those purposes. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer. Some of these technologies may be provided by third-party analytics or advertising providers. We do not sell your personal information. In order to provide our services, we necessarily share personal information with lenders and other parties involved in arranging your financing. We may disclose personal information:

•     to lenders and financial institutions, in order to obtain quotes, submit applications, and arrange financing on your behalf, where they will handle your information under their own privacy policies;

•     otherwise with your consent or as permitted or required by applicable law.

10. Service providers and transfers outside your province or Canada

Some of our lenders and service providers may store or process personal information outside your province of residence or outside Canada. When personal information is handled by a party in another jurisdiction, it is subject to the laws of that jurisdiction and may be accessible to the courts, law-enforcement, and regulatory authorities there. We use contractual and other reasonable measures to require our service providers to protect personal information in a manner consistent with this Privacy Policy and applicable law. You may contact our Privacy Officer for more information about our policies and practices regarding service providers outside Canada.

11. Safeguards

We maintain physical, organizational, and technological safeguards appropriate to the sensitivity of the personal information to protect it against loss or theft and unauthorized access, disclosure, copying, use, or modification. These measures may include restricted access, secure storage, encryption in transit where appropriate, confidentiality obligations, and staff training. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security.

12. Retention

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected and to meet legal, regulatory, tax, and business requirements, which for credit and financial records may be a period of several years after our relationship or your financing ends. When personal information is no longer required, we take reasonable steps to securely destroy, erase, or anonymize it.

13. Accuracy, access, and correction

We take reasonable steps to keep personal information accurate, complete, and up to date for the purposes for which it is used.
